David Clement has been with Perry Dampf since 2014 and has served as a mediator, arbitrator, and umpire for a wide variety of civil disputes. Mr. Clement’s unique background in Architecture provides special insight for the mediator’s evaluative role in construction, property damage, and insurance bad faith mediations. In addition, Mr. Clement serves as an Adjunct Professor at Loyola University New Orleans College of Law teaching Mediation and Arbitration to third- and fourth-year law students.

PROFILE

Mr. Clement is a founding member of the New Orleans law firm of Clement & Associates, Counselors at Law, LLC. He has extensive experience with every facet of a construction project and began his career in architecture after receiving a Bachelor of Architecture from Louisiana Tech University in 1990. Since being admitted to practice law in 1995, he has also been admitted in the U.S District Court: Eastern and Western Districts of Louisiana, the U.S. Court of Appeals, Fifth Circuit as well as the Supreme Court of the United States. Mr. Clement has represented architects, engineers, owners, developers, sureties, insurers, contractors, and subcontractors in the areas of real estate, construction, and insurance law. As a result of the devastating effects of Hurricanes Katrina, Rita, and Ida in Louisiana and the related litigation that followed, Mr. Clement also gained extensive experience in the areas of first party insurance claims, bad faith insurance claims handling and insurance agent malpractice. Appraisal umpiring involves complex construction scope and price disputes, for which Mr. Clement has nearly 30 years of construction related experience. Additionally, he has extensive experience in mediation and litigation since Hurricane Katrina with the Xactimate and Simsol estimating software that are customarily involved in the estimating and appraisal process. Mr. Clement is currently serving on a panel created by the Louisiana Insurance Commissioner to mediate Hurricane Ida claims in an expeditious manner.

In 2013, Mr. Clement completed coursework at the Harvard Negotiation Institute, which is widely accepted as one of the nation’s finest mediation training courses. Since 2019, Mr. Clement has also taught Mediation and Arbitration at Loyola University New Orleans College of Law.

Mr. Clement is a member of the American Bar Association Forum on the Construction Industry, Louisiana State Bar Association, New Orleans Bar Association, and American Institute of Architects.
